Purpose

 The Orange Grove Independent School District provides technology resources to all District administrators, faculty, staff, and students.  The goal in providing these resources is to promote educational excellence by following the Acceptable Use Guidelines. The District’s technology resources will be used only for learning, teaching and administrative purposes consistent with the District’s mission and goals.

 The Acceptable Use Policy procedures that follow provide details regarding the appropriate and inappropriate use of District computers.  The procedures do not attempt to articulate all required or proscribed behavior by users.  All users are expected to use the computers and computer networks in a responsible, ethical, and polite manner.  You, the user, are ultimately responsible for your actions in accessing and using District computers and the District computer network.  As a user of the District computers, you are expected to review and understand the guidelines and procedures in this document.

 Personal Responsibility

 By signing this Policy, a user is agreeing not only to follow the rules in this Policy, but also is agreeing to report any misuse of the network to the person designated by the School for such reporting.  Misuse means any violations of this Policy or any other use that is not included in the Policy, but has the effect of harming another or his or her property or privacy.

 Term of the Permitted Use

 A user who submits to the school, as directed, a properly signed policy and follows the policy to which he or she has agreed will have computer network and Internet access during the course of the school year.  Users will be asked to sign a new policy each year before they are given an access account.  Users should not disclose or share their password or use the account of another student or staff member.  A user is responsible for all activity logged under his or her account name.

 Appropriate Use Procedures

 The District expects everyone to exercise good judgment and use the computer equipment in a professional manner.  The School will also monitor the of students, through direct observation online activities and/or technological means, to ensure that students are not accessing such content or any other material that is inappropriate for minors. Use of the equipment is expected to be related to the District’s goals of educating students and/or conducting District business.  If a user has any doubt about whether a contemplated activity is educationally related, he or she may consult with the District Technology Coordinator or other school designee. The District recognizes, however, that some personal use is inevitable, and that incidental and occasional personal use that is infrequent or brief in duration is permitted so long that as it occurs on personal time, does not interfere with District business, instructional time, and is not otherwise prohibited by District policy or procedures.

 Inappropriate Use

 Prohibited Uses: District Computers may not be used for the following purposes:

bulletCommercial Use: Using District Computers for personal or private gain, personal business, or commercial advantage is prohibited.
bulletPolitical Use: Using District Computers for political purposes in violation of federal, state, or local laws is prohibited. This prohibition includes using District computers to assist or to advocate, directly or indirectly, for or against a ballot proposition and/or the election of any person to any office. The use of District Computers for the expression of personal political opinions to elected officials is prohibited. Only those staff authorized by the Superintendent may express the District’s position on pending legislation or other policy matters.
bulletIllegal or Indecent Use: Using District Computers for illegal, harassing, vandalizing, inappropriate, or indecent purposes (including accessing, storing, or viewing pornographic, indecent, or otherwise inappropriate material), or in support of such activities is prohibited. Illegal activities are any violations of federal, state, or local laws (for example, copyright infringement, publishing defamatory information, or committing fraud). Harassment includes slurs, comments, jokes, innuendoes, unwelcome compliments, cartoons, pranks, or verbal conduct relating to an individual that (1) have the purpose or effect or creating and intimidating, a hostile or offensive environment; (2) have the purpose or effect of unreasonably interfering with an individual’s work or school performance, or (3) interfere with school operations. Vandalism is any attempt to harm or destroy the operating system, application software, or data. Inappropriate use includes any violation of the purpose and goal of the network. Indecent activities include violations of generally accepted social standards for use of publicly owned and operated equipment.
bulletNon-District Employee Use: District Computers may only be used by District staff and students, and others expressly authorized by the District to use the equipment.
bulletDisruptive Use: District Computers may not be used to interfere or disrupt other users, services, or equipment. For example, disruptions include distribution of unsolicited advertising (“Spam”), propagation of computer viruses, distribution of large quantities of information that may overwhelm the system (chain letters, network games, or broadcasting messages), and any unauthorized access to or destruction of District Computers or other resources accessible through the District’s computer network ("Cracking" or "Hacking").

Care for District Computers

Users of District Computers are expected to respect the District’s property and be responsible in using the equipment. Users are to follow any District instructions regarding maintenance or care of the equipment. Users may be held responsible for any damage caused by your intentional or negligent acts in caring for District Computers under your control. The District is responsible for any routine maintenance or standard repairs to District Computers. Users are expected to timely notify the District of any need for service.

If a District laptop is lost, damaged, or stolen while under the control of a user, the user is expected to file a claim under his/her insurance coverage, where coverage is available. Except in cases of negligent or intentional loss or damage, the District will cover out-of-pocket expenses.

Software

Use of District Software: District software is licensed to the District by a large number of vendors and may have specific license restrictions regarding copying or using a particular program. Users of District software must obtain permission from the District prior to copying or loading District software onto any computer, whether the computer is privately owned or is a District Computer.  District approved software used for educational purposes (Gradespeed, Novanet) must be uninstalled from the employees personal computer upon termination from employment.

Use of Non-District Software

Prior to loading non-District software onto District Computers (including laptops, desktops, and OGISDNet), a user must receive permission from the District. The District will create a list of "authorized software" programs that may be loaded onto District laptops without specific permission. For example, a user will be able to load software onto a laptop that is necessary for a user to access a personal Internet service for the purpose of remotely accessing the District’s email network. All software must be legally licensed by the user prior to loading onto District Equipment. The unauthorized use of and/or copying of software are illegal.  Unauthorized use of software is regarded as a serious matter and any such use is without the consent of OGISD."

Monitoring/Using Internet and the World Wide Web

bulletBe circumspect about where you go and what you do. Do not visit any site or download or share any material that might cause anyone to question your professionalism, or the District’s.
bulletRead the "License" or "Legal" contract terms on every site. Do not purport to bind the District to any license or other contract. If you make an agreement on your own behalf, do not violate that agreement using the District equipment or Internet account.

The District will monitor and review the information in order to analyze the use of systems or compliance with policies, conduct audits, review performance or conduct, obtain information, or for other reasons. The District reserves the right to disclose any electronic message to law enforcement officials, and under some circumstances, may be required to disclose information to law enforcement officials, the public, or other third parties, for example, in response to a document production request made in a lawsuit involving the District or by a third party against the user or pursuant to a public records disclosure request.

Active Restriction Measures

 The School, either by itself or in combination with the Educational Service Center providing Internet access, will utilize filtering software or other technologies to prevent students from accessing visual depictions that are (1) obscene, (2) pornographic, or (3) harmful to minors. The School will also monitor the of students, through direct observation online activities and/or technological means, to ensure that students are not accessing such content or any other material that is inappropriate for minors. Internet filtering software or other technology-based protection systems may be disabled by a supervising teacher or school administrator, as necessary, for purposes of bona fide researcher other educational projects being conducted by students age 17 and older.

Consequences of improper use

Improper or unethical or any violation of this policy use may result in disciplinary actions consistent with the existing Student Discipline Policy and, if appropriate, the Texas Penal Code, Computer Crimes, Chapter 33, or other state and federal laws. The Appropriate Use Procedures are applicable to all users of District Computers and refers to all information resources whether individually controlled, shared, stand alone, or networked. Disciplinary action, if any, for students, staff, and other users shall be consistent with the District’s standard policies and practices. Violations may constitute cause for revocation of access privileges, suspension of access to District computers, other school disciplinary action, and/or appropriate legal action. Specific disciplinary measures will be determined on a case-by-case basis.

This may also require restitution for costs associated with system restoration, hardware, or software costs.

Disclaimer

The District's system is provided on an "as is, as available" basis. The District does not make any warranties, whether expressed or implied, including, without limitation, those of fitness for a particular purpose with respect to any services provided by the system and any information or software contained therein. The District uses a variety of vendor supplied hardware and software. Therefore, the District does not warrant that the functions or services performed by, or that the information or software contained on the system will meet the user's requirements. Neither does the District warrant that the system will be uninterrupted or error-free, nor that defects will be corrected.

Opinions, advice, services, and all other information expressed by system users, information providers, service providers, or other third party individuals in the system are those of the providers and not necessarily the District.

**Since technology and the Internet are constantly changing, these rules and regulations are subject to change by the administration.  Students will be notified when such changes are made.
